Standing firm against village green proposal

Opposing an application to create a village green on part of her client’s land, Rosalind Andrews from our planning team won the day, so that the land stayed under their control.

She was called upon when a local residents applied to the local authority to register part of the client’s land as a town and village green. If the application had succeeded, the public would have had the right to use it for recreational purposes, but that the client would have to maintain it and could not use it for anything which interfered with its public use. It would have not only become worthless to them but also a liability.

With her support and advice, the client gathered evidence and objected to the application strongly – an independent inspector was appointed to consider the matter; they agreed with the objection and the application was dismissed.
