Andrea Thomas advises on how to handle some delicate situations. The pandemic had some unexpected consequences, not least the need for landlords and tenants to discuss their contracts, obligations and commitments; Justin Mason looks at how this has worked and hopes for a continuation of increased communications in the future. Covid-19 has also changed the law on the witnessing of wills, as Nerys Thomas reveals, with video calls now an acceptable way of having your will witnessed officially. Will the gloves come off on 30 September 2020? |
Any relationship has its moments. For landlords and tenants of commercial leases, the Covid-19 pandemic has put that particular contractual relationship under immense strain. A key date is looming as 30 September 2020 sees the expiry of certain measures under the Coronavirus Act 2020 which will allow landlords to take enforcement action against tenants of commercial premises who have not paid their rent. |

Witnessing wills – the way ahead with new technology |
The effects of Covid-19 have seen an increase in the number of clients approaching us to draft their wills. Until this year, the way in which wills need to be witnessed had not changed since 1837, but the pandemic has prompted a (retrospective) change to the law.
Wills must be signed by the maker in the presence of two witnesses, who then have to sign the document themselves in the presence of the maker and of each other. With strict measures in place around social distancing, people have had concerns about meeting with their witnesses (who are likely to come from outside their bubble) to sign their will. |

Shielding paused in Wales from 16 August 2020: employment implications |
The Welsh Government has amended its Covid-19 guidance for people who are shielding in Wales because they are ‘extremely vulnerable’, meaning that those people no longer need to shield from mid-August. New guidance has been issued, which is in addition to the requirements set out by the Health Protection (Coronavirus Restrictions) (No. 2) (Wales) Regulations 2020 (Regulations). This includes guidance on returning to work. |
