Questions my clients ask me
Sanctions are complicated and it can be difficult to know what is allowed and what is not allowed. Breaching sanctions can give rise to prosecution. Always err on the side of caution and take legal advice when in doubt.
If you are found to be operating as a partnership – without having a formal written agreement in place – you will be governed by the terms of the Partnerships Act 1890. Some of the rules in this act may not be beneficial for your business and could lead to more difficulties, especially if your relationship with the other person / people breaks down. We recommend that you take advice if you think that you might be part of a partnership.
It’s best to take advice before signing the agreement so you can protect your position.
