Expert legal advice secures new site for Lidl

A landowner in Lydney successfully sold their property to German supermarket giant Lidl, thanks to expert advice from Mark Fabian, partner in our commercial property team in Cheltenham.

Watts of Lydney Group Limited received an offer from Lidl to buy the land for a new superstore. However, this was subject to various conditions including planning permission, ecological assessment, and obtaining vacant possession from tenants. Mark’s real estate expertise was called upon to untangle complications in order to sell the freehold; he had acted for Watts before on the Lidl site in Gloucester.

It was thanks to Mark and the HCR team that the client could enter into a conditional contract with Lidl and satisfy conditions which were delaying the sale of the site. The contract involved many factors, including a negotiation over revised tenancy agreements and a unilateral undertaking regarding highway requirements to facilitate Lidl’s planning application.
