Agriculture and Estates Partner provides expertise in land dispute

A Wales-based landowner found himself in a dispute with the local authority when he developed plots on his land. The dispute was in relation to the terms of a Section 106 Agreement – a legally binding agreement between a planning authority and a property owner – principally because additional costs had been incurred in the development as a result of difficulties resolving an attenuation scheme for the site.

At this point, the landowner turned to Partner in the Agriculture and Estates team Rory Hutchings for guidance. Rory has been part of extensive negotiations between the parties – the outcome hoped for is that they are able to agree an alternative scheme and a framework for negotiation of new Section 106 obligations.
