Questions my clients ask me

Every case turns on its own facts; how much each party retains as part of a financial settlement associated with divorce depends on the level of overall marital assets. Full financial disclosure needs to be provided – affordability, needs and standard of living enjoyed during the partnership will all be considered.

The extent of the level of the other assets, and factors such as the type of pension fund and when it was accrued will all influence how the pension fund could be treated by the court. The age of the parties and their needs will also be considered. If the pension fund is considered marital, your pension can be subject to a pension share – or you could offset your ex-spouse’s claim by providing additional capital from other sources.

The costs of negotiating a financial settlement can be variable depending on the issues in dispute and the conduct of both parties. Alternative methods of resolving your disputes can assist with keeping costs down, and you should discuss with your solicitor mediation, arbitration, private FDR and round-table meetings.
