The executors are the individuals entrusted with enacting the wishes of your will and the administration of the estate. You can appoint anyone over the age of 18; this can also be beneficiaries, or you could appoint professionals such as a firm of solicitors. When appointing professionals, fees would apply which would be chargeable against the estate.

Lasting powers of attorney (LPAs) are legal documents that allow someone (the “donor”) to appoint trusted individual(s) to make decisions on their behalf in relation to their property and financial affairs or health and welfare, primarily when they lack mental capacity to do so themselves. The donor can only undertake the process whilst they have mental capacity. Unfortunately, no one knows when capacity will become an issue, so it’s key to get these in place while you are able.

In the absence of a will, your estate would pass under the rules of intestacy to your legal next of kin. Under the intestacy rules, individuals who you may wish to benefit could be excluded or individuals who you do not wish to benefit could be entitled. It also could possibly affect the tax efficiency of your estate. Therefore, to create certainty and peace of mind for yourself, it’s always advisable to have your wishes set out in a will and to review your will regularly.
