Questions my clients ask me
Once I have considered the scope and requirements of your instructions, we will agree an assessment of the likely fees, costs, expenses and disbursements before proceeding with any chargeable work.
While some rights may arise automatically, for example by statute or as a consequence of entering into a transfer deed, these may not reflect what the parties anticipate or require. We will consider and identify the rights and restrictions that should be granted and reserved, taking into account the specific circumstances of the land involved. A suitably scaled land plan will need to be prepared by a surveyor, and we can assist in arranging this if required. This will enable me to draft the necessary provisions in the transfer deed, addressing matters including access rights, utilities, maintenance obligations and any other requirements specific to the transaction.
Not yet. We will need to deal with the payment of any Stamp Duty Land Tax and apply to HM Land Registry to register the transfer. Only once HM Land Registry has completed the registration and updated its records to show you as the registered proprietor will the land be legally owned by you.
