Suzanne Whyman

Senior Associate (TEP)

Why choose me

For me, private client work involves building close relationships with people and working with them over a period of time, sometimes years, to achieve their goals. This is often true for farming clients who have complex affairs which may need to be reviewed and potentially reorganised. Being the granddaughter of a dairy farmer, I have a particular interest in helping farming families.

I work alongside my clients to anticipate potential problems so that these may be pre-emptively addressed. My clients include private individuals including farmers, business owners and those with assets abroad. I also advise trustees in relation to the settlements under their control.

I provide advice in relation to the creation of Wills and trusts, trust administration (including winding up), inheritance tax (including tax mitigation), powers of attorney, estate administration and co-ownership advice.

Outside work, I enjoy being active, especially outdoors. Whether it be hiking, skiing, mountain biking or even canyoning! I like planning and working on my garden and experimenting with cooking. I appreciate classic cars and would love to own a VW Karmann Ghia or Porsche Speedster one day!

Questions my clients ask me

It depends on your circumstances; whether your estate is likely to be complex to administer, what assets are in your estate and whether there are any other complicating factors such as a potential claim. Most importantly, however, you need to appoint people who you trust and are organised, can act impartially and are financially sensible. It is also helpful to appoint those who are, if possible, a generation below you. There also may be reasons to consider appointing professional executors.

As a guide, every five years or so, but certainly on ‘life events’ such a marriage or civil partnership, following a death, divorce or separation, or upon receiving a large inheritance.

This is not something I would recommend. Your home is usually your most important asset. If you give it away outright it is then vulnerable in the event of any divorce or bankruptcy of the recipient and if that person dies it would pass by his/her Will or intestacy, over which you have no control. It could also be used by the recipient as security for a loan. The gift may be challenged if the Local Authority suspects the main reason for gifting your home was to avoid paying for care, and there are tax consequences for both you and the recipient.
