Phishing alert – beware of fake trademark solicitation emails

At HCR Law, the protection of our clients and community from fraudulent activity is a top priority. Recently, several clients reported receiving unsolicited emails claiming to be from various law firms.

These emails are not only misleading—they are part of a phishing scam designed to pressure recipients into making hasty decisions based on fear and misinformation.

How do you recognise this type of phishing email?

The email typically begins with legal-sounding language such as:

“I am reaching out on behalf of [law firm name] regarding the application for legal protection of the brand name ‘XXXXX’ under UK intellectual property laws…”

It then claims that another party is applying to register the name and implies that you could lose the right to use your business name if you don’t act immediately. This kind of scare tactic is a classic hallmark of phishing scams.

Why is this a scam?

1. No legitimate authority

There is often no known law firm of the given name listed with the Solicitors Regulation Authority (SRA) or Intellectual Property Regulatory Board (IPREG) in the UK.

2. Fear-based pressure

The email uses urgency and fear to push recipients into a response, claiming someone else is about to take over your trademark unless you act immediately. This is not how the trademark registration system in the UK works.

3. Trademark applications are public

If someone genuinely applies to register a similar or identical name, it goes through a formal review and publication process via the UK Intellectual Property Office (UKIPO).

You are given the opportunity to oppose such applications through official channels—not via unsolicited emails.

4. Phishing motive

These emails may be attempting to gather sensitive information, solicit fraudulent payments, or direct you to fake legal services.

I think I’ve received a phishing email, what should I do?

Do not respond to the email. Engaging can expose you to further phishing attempts or pressure tactics. Report it to Action Fraud UK (https://www.actionfraud.police.uk/) and forward the email to [email protected].
