My practice covers a broad spectrum of commercial disputes; and I have developed an expertise in financial services and banking disputes. This also includes in the pensions arena, where I assist my clients to achieve suitable resolution to their issues.

Kunjan Sembhi

Senior Associate, Pensions

Pensions law is a niche area – and one which can lead to complex disputes. I work alongside my clients to ensure disputes can be managed and resolved, from those to do with the Pensions Regulator and Ombudsman to those on the equalisation of benefits.

Our experience

Our team of pension dispute experts deal with a range of matters. These include everything from advising on disputed trustee powers of amendment to hostile negotiations in reorganisations involving distressed businesses. We also negotiate on switches from RPI pension increases, where necessary, through the courts, and advise on the equalisation of pension benefits in schemes.

We advise on professional negligence claims arising from mistakes and breaches of fiduciary duty, the impact of age and sex discrimination legislation and regularly defend complaints against trustees under a scheme’s internal disputes resolution procedure or with the Pensions Ombudsman.

We also have experience of High Court applications for declaratory relief on the interpretation of trustee powers and can assist representative beneficiaries who may be appointed as a party to a claim.

Our clients

We work with trustees, employers and representative beneficiaries in relation to defined benefit and defined contribution schemes across the private and public sector.

If you are a pension scheme member, we suggest that you use the scheme’s internal dispute resolution procedure. You could also contact The Pensions Ombudsman whose early resolution service helps people mediate and resolve disputes.
