How do I get a refund from my credit card?

You have heard about credit card protection – but how does it work?

Your purchases on a credit card are protected by Section 75 of the Consumer Credit Act 1974. Section 75 provides protection to consumers who use a credit card for purchasing a product or a service for more than £100 and up to £30,000. Under this section, a credit card company is also jointly and severally liable for any breach or misrepresentation by the retailer or trader and protection is available for partial payments via a credit card. Section 75 does not apply to debit cards or any other form of bank or charge cards.

What are my rights?

Under Section 75 you are legally entitled to get your money back if:

– There is a link between the credit card company and the retailer; cash withdrawals via credit card will be not covered as there is no link
– The product or service is faulty
– There has been misrepresentation or breach of contract between you and the company you bought the product or service from
– The company you bought the product or service from does not deliver the product or service.

Time limits

To make a claim under Section 75 you must collect evidence and make a claim within six years of buying the products or services or, in cases of non–receipt, from when you were due to receive them.

The protection of Section 75 does not apply in the following circumstances:

– the purchase of any land
– products or services paid for by a secondary cardholder
– hire purchase agreements e.g. car finance
– where goods or services are bought through intermediaries including, but not limited to, PayPal, Amazon, Expedia or Ebay.

How to make a claim?

Contact your credit card company and discuss the protection. If the credit card company does not accept your claim, or refuses to pay up, then we can provide advice tailored to your unique circumstances and the result you want.
