When your business runs into trouble, it can be highly stressful and difficult to know what steps to take next. I’m here to help you plot a path for survival, with the aim that you keep on trading, even if that means entering into an insolvency process.

Practical support for lenders

When a borrower has defaulted and you need to enforce your security against a specific asset or class of asset they own, we’re here to help.

We’ll appoint the fixed charge receiver then work closely with them and you to manage the situation so you have confidence the fixed charge is being handled in the most advantageous way.

This might simply be the sale of the asset. It might also be any other activity needed to achieve the best possible realisation, such as completing a development and arranging its marketing and sale. In an optimum scenario, it might even include returning a surplus to the borrower after all costs and expenses have been met.

A proven track record of success

We act on behalf of lenders including high street and challenger banks, holders of agricultural charges, and private lenders. We also work on behalf of national and local accountancy firms, and property agents appointed by lenders. In other circumstances, we act on behalf of borrowers themselves.

This broad spectrum of experience means we understand the needs of all stakeholders and are able to anticipate and resolve any potential issues along the way.

Hear what our clients say about us

I have worked with Sam now on many turnaround assignments over the last 15 years. I have always found him to be extremely focused and user-friendly with an innate ability to engage successfully with all key stakeholders. I have worked particularly closely with Sam on mid-market manufacturing and retail assignments, as well as large national charities. I would always recommend Sam to directors who need expert legal assistance in navigating difficult times and support with engagement with all stakeholders as they drive towards a successful turnaround.

Dr Mark Taylor Bluesky Associates Turnaround & Transformation Advisory LLP

Sam is great at building relationships, has a strong knowledge of the marketplace and will make introductions to relevant third parties. He is proactive and very commercial, coming up with suggestions and solutions that we hadn’t thought of. Sam doesn’t just focus on the legal documentation, but also uses his mind to find ways forward. He is very down to earth and is never difficult to get hold of. Sam offers a genuine, partner-led approach.

Jo Power FRP (previously ExWorks)

This is the best news, thank you so much. Deanne, you have been wonderful throughout and especially helping me with my serious upset and frantic feelings, you have gone above and beyond anything expected.

I am so grateful for all your kindness throughout this whole process.
