SEND tribunal successfully navigated following Partner’s advice

The Academies team have significant experience in assisting schools with complex issues which arise in respect of SEN and disability. They supported schools and colleges challenging the decision of local authorities to name the institution in a young person’s Education, Health and Care Plan (EHCP).

Head of Academies Emma Swann helped navigate the First Tier SEND tribunal, citing concerns in respect of suitability; resources, and the impact on staff and other students should the young person be given a placement. Emma has also provided advice to schools in respect of successfully challenging the decision under the Education Act 1996 before the Secretary of State.

Emma has provided her expertise when advising schools and colleges in relation to managing parental complaints and disability discrimination claims. Emma has guided schools through providing a response to the claim, preparing witness statements and helping to negotiate a settlement where practical. Emma also advises schools in respect of the reasonable adjustments they may need to consider on admission of a student or when planning a school trip overseas. She has also extensively helped schools to effectively manage parental complaints in respect of SEN provision.
