Tribunal Claims – For Employers

Created to protect employees from being treated unfairly, the employment tribunal process aims to resolve workplace disputes. It can, however, be complex for all involved.

With extensive experience advising clients facing employment tribunal claims, our specialist team will guide you through the process, protecting your interests and minimising the effect on the wider business.

Managing the tribunal process

With multiple stages, strict timeframes for submitting documentation and the volume of evidence often presented, an employment tribunal can appear daunting.

Our experienced team will by your side throughout, taking time to understand your objectives, and providing commercial and pragmatic advice. The ramifications of tribunals can wide-reaching, potentially affecting a client’s reputation, workforce and wider business relationships. We take steps to minimise the impact on the business, making sure you are fully prepared and keeping you informed throughout.

While tribunals can often be complicated, some are more easily resolved. For potentially simpler claims, such as unlawful deductions of wages or unfair dismissal, we use our experience advising on similar cases to recommend the best route to resolve the situation, as quickly and cost efficiently as possible.

Our expertise

Every tribunal case is unique. Our lawyers are specialists in this area, having successfully managed numerous, often complex, employment tribunal claims for clients. And our clients benefit from this experience at every stage, from preparing proceedings, drafting witness statements or employment tribunal applications through to the final hearing. We also manage negotiations, liaising with ACAS and preparing settlement or COT3 agreements.

We have particular experience in protective award claims under TUPE law, including collective claims following redundancy, as well as whistle blowing and discrimination claims. And should you experience a vexatious claim from a serial claimant, you’re in the right place. We have a proven track record defending these types of claims, acting quickly and robustly to resolve the situation for our clients.

I want to extend a special thanks to you for sharing such valuable insights in your Employment Rights Bill training. Your detailed review of the bill and key information you provided was incredibly helpful. It gave us a clear understanding of what we can do moving forward, and we are excited to put this into practice.

Adam Cotterill was incredibly helpful in guiding me and my partner through the process of reapplying for our UK Unmarried Couples visa. After our initial application was rejected, we were extremely stressed and unsure of how to proceed. Adam supported us every step of the way, providing clear advice, reassurance and guidance. Thanks to his expertise, the process felt far more manageable, and we felt confident in our reapplication.

HCR supported us in managing an employee settlement agreement. As an owner-led SME without internal HR or legal support, Lisa Kemp provided surety, a safe pair of hands and direct, clear, pragmatic advice. We also felt she was thoughtful of time and therefore cost, throughout the process. We’d happily recommend both HCR and Lisa to other organisations seeking similar legal support.

The team is very responsive, and I like the way that they ensure that more than one team member is familiar with a case so that they can give seamless advice in the absence of the lead lawyer.
